Terms of Service

1. Scope and eligibility

The Website provides studio and game information, news, promotional materials, and ways to contact us. Games, playtests, and promotions may have additional terms presented with that offering. Those terms take priority for the particular offering if they conflict with these Terms. Store terms and the applicable app license govern store transactions and app licensing as described below.

You must have legal capacity to agree to these Terms. If you have not reached the age of legal adulthood where you live, a parent or legal guardian must review and agree to the applicable Terms on your behalf where the law requires it. Follow the age rating, minimum age, and parental permission requirements stated for each Game and store. A store rating describes content suitability; it does not replace any legally required parental consent.

2. Game licenses and app stores

Apple App Store: unless a different license is expressly supplied with a particular Game through Apple, our Apple-distributed Games use Apple's Standard End User License Agreement. Sefidel is the application provider and licensor of its Games. These Terms supplement that license for our services and do not replace it or restrict the usage rights it grants. If there is a conflict about app licensing, the applicable Apple license and usage rules control.

Google Play and other stores: subject to the applicable store terms, any separate license supplied with the Game, and applicable law, Sefidel grants you a limited, nonexclusive license to install and play a lawfully obtained Game for personal, noncommercial use on devices you own or control. Store-authorized family sharing and other mandatory usage rights remain available. Games are licensed, not sold; Sefidel and its licensors retain ownership of the software and content.

You may not resell or redistribute a Game, use pirated copies, bypass purchase or security controls, or reverse engineer the software except as permitted by applicable law or an applicable open-source license. These restrictions do not prohibit ordinary gameplay videos, reviews, accessibility uses permitted by law, or rights granted by a separate permission.

Sefidel provides support for its Games; Apple and Google do not undertake our developer support obligations. Contact us using the details below for technical problems, complaints, or claims. Applicable store agreements and consumer law continue to govern each party's responsibilities.

3. Acceptable use

You may use the Website and Games for lawful purposes and in accordance with these Terms. You must not:

• Violate applicable law or another person's intellectual property, privacy, or other rights.
• Attempt to access restricted areas, accounts, systems, or data without authorization, or bypass security measures.
• Introduce malware, interfere with the Website's operation, or use automated requests that disrupt or place an unreasonable burden on the Website.
• Use the Website to send spam, threats, harassment, fraudulent messages, or unlawful material.
• Impersonate Sefidel or another person, or falsely suggest that we sponsor or endorse you.
• Cheat in online play, manipulate leaderboards or transactions, or interfere with another player's access to a Game.

Nothing in these Terms restricts honest reviews, lawful criticism, legally protected reporting, or other rights that cannot be limited by contract.

4. Intellectual property

The Website and its original text, artwork, logos, videos, designs, and other materials are owned by Sefidel or our licensors and are protected by applicable intellectual property laws. Third-party names and marks belong to their respective owners.

You may browse the Website, link to publicly available pages, and make personal, noncommercial copies of publicly available materials, provided you retain copyright and other proprietary notices. Other reproduction, modification, redistribution, or commercial use requires permission from the relevant rights holder unless permitted by law or by a separate license. Any specific press-kit or asset permissions apply to the materials they cover.

These Terms do not transfer ownership of our content. Game licenses are addressed above. Nothing here limits fair use or other statutory exceptions.

5. Game information and availability

Game announcements, screenshots, trailers, features, supported platforms, and target release dates may describe work in progress and may change. Unless expressly stated in a separate offer, they are informational and are not a promise to release a game on a particular date or with particular features. We may correct errors and update information as development progresses.

Any purchase, preorder, playtest access, or promotional offer is subject to the terms provided for that offering and applicable consumer law.

6. Third-party services and purchases

The Website may link to or display content from third-party stores, video platforms, social networks, or other services. Those services are operated independently and have their own terms and privacy practices. We do not control their content, availability, or operation.

If you purchase a game or other product through a third-party store, review that store's payment, delivery, cancellation, and refund terms, together with any applicable game license. These Terms do not replace those terms or reduce any mandatory refund or other consumer rights you have under applicable law.

In-app purchases: where a Game offers paid content or features, the purchase screen identifies the item, price, and applicable conditions before you authorize payment. Payments use the relevant store's billing system or another method permitted by that store and applicable law. We do not receive your full payment-card details from purchases processed by Apple or Google. Store purchases are subject to the applicable store agreement and mandatory consumer rights.

Ad removal: if offered as a one-time purchase, ad removal is not a recurring subscription. The offer explains which advertisements it removes and whether optional rewarded ads remain. Restoring an eligible nonconsumable purchase uses the purchasing store account and the Game's restore or entitlement-recovery process; cross-platform transfer is available only if expressly offered.

Our Games' ad-removal purchases are one-time purchases, not recurring subscriptions. Buying ad removal does not automatically disable crash reporting or erase previously collected information; see the Privacy Policy for data choices.

Refunds and purchase support: for an Apple purchase, use Apple's purchase support; for a Google Play purchase, use Google Play's refund process. You may also contact Sefidel for help. Nothing here makes a purchase nonrefundable where the store or applicable law provides a refund, remedy, or withdrawal right.

7. Player data and saved progress

Our Games do not offer Sefidel player accounts or in-game chat. Your Apple or Google store account is separate and is managed by its provider. Restricted studio administrator accounts on this Website are not player accounts.

You can request deletion of personal information through our data deletion instructions. No Sefidel player account needs to be closed. Uninstalling a Game does not itself request deletion of information already transmitted to us or our providers. Retention exceptions and privacy rights are explained in the Privacy Policy.

Local saves may be lost if you uninstall a Game, clear its storage, or change devices. Do not assume a Game supports cloud saves or synchronization unless that feature is expressly offered. Deleting data does not by itself determine a refund entitlement or erase a store's purchase record.

8. Communications and feedback

When contacting us, provide accurate information and only send material you have the right to share. Please do not send passwords, payment-card details, or confidential information that is not needed to address your request.

You retain ownership of material you send us. You allow us to use it as reasonably necessary to receive, review, and respond to your message. If you voluntarily provide suggestions for improving our Website or games, you allow us to use those suggestions without an obligation to compensate you, unless we agree otherwise in writing. This does not transfer ownership of your work or give us ownership of your reviews.

9. Privacy

Our Privacy Policy explains how we handle personal information. These Terms do not serve as consent to marketing. Contact admin@sefidel.com with questions about personal information or to make a privacy request. Third-party services you choose to visit or interact with have their own privacy notices.

10. Website disclaimers

We aim to keep the Website useful and accurate, but we cannot guarantee that it will always be available, uninterrupted, secure, error-free, or up to date. To the extent permitted by applicable law, the Website and its informational content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

This disclaimer applies only to the Website. It does not override express commitments in a separate agreement or any warranties, guarantees, or rights that cannot lawfully be excluded.

11. Limitations of liability

To the extent permitted by applicable law, Sefidel will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Website, including resulting loss of profits, business opportunities, or data.

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, willful misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. If applicable law does not allow a particular exclusion or limitation, that exclusion or limitation does not apply to you.

12. Changes to the Website and access

We may update, suspend, or discontinue all or part of the Website for maintenance, security, legal, or operational reasons. We may restrict access when reasonably necessary to address misuse, a breach of these Terms, or a risk to the Website or others. Where practicable and required by law, we will provide notice.

You may stop using the Website at any time. Ending Website access does not by itself cancel a separately purchased game license or remove rights you have under a separate agreement or applicable law.

13. Changes to these Terms

We may revise these Terms from time to time by posting an updated version on this page and changing the effective date above. Changes apply prospectively. For material changes, we will provide additional notice through the affected service and obtain consent where required by law. Changes do not retroactively remove purchase entitlements or mandatory consumer rights. If you do not agree to updated Terms, stop using the affected service, subject to any rights you retain under your existing license or applicable law.

14. General terms and disputes

If you have a concern, please contact us so we can try to resolve it. Contacting us does not prevent you from exercising legal rights, bringing a claim in a court with jurisdiction, or contacting a consumer protection authority. These Terms do not impose mandatory arbitration or waive class-action rights, and they do not deprive you of mandatory protections under the laws that apply to you.

If a provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision is not a waiver of the right to enforce it later. These Terms, together with the applicable app license and any expressly applicable additional terms, form the agreement regarding your use of the relevant service.
